Glosa częściowo krytyczna do wyroku Sądu Najwyższego z dnia 10 listopada 2017 r., sygn. V CSK 41/14

Abstract

Celem niniejszej publikacji jest analiza wyroku Sądu Najwyższego z dnia 10 listopada 2017 r., sygn. V CSK 41/14. Wyrok ten dotyczył dopuszczalności orzeczenia na podstawie art. 79 ust. 1 pkt 3 lit. b ustawy z dnia 4 lutego 1994 roku o prawie autorskim i prawach pokrewnych, odszkodowania za naruszenie autorskich praw majątkowych w wysokości dwukrotności należnej uprawnionemu opłaty. Autor poddaje analizie ww. orzeczenie Sądu Najwyższego porównując wnioski w nim zawarte do poglądów części przedstawicieli doktryny polskiego prawa własności intelektualnej.

The purpose of the article is analysis of the Supreme Court’s Judgment of November 10, 2017 (Ref. No. V CSK 41/14). The verdict concerned the admissibility of the judgment on the basis of art. 79 paragraph 1 point 3 lit. b of the Act of February 4, 1994 on copyright and related rights, compensation for infringement of proprietary copyrights in the amount of twice the amount due to the entitled party. The author analyzes the abovementioned decision of the Supreme Court comparing the conclusions contained therein to the views of representatives of the doctrine of Polish intellectual property law.
