Instytucja czynnego żalu jest jedną z najważniejszych instytucji prawa karnego. Głównym celem tej regulacji jest odstraszenie sprawcy od popełnienia czynu przestępnego. Czynny żal pozostaje w korelacji z odpowiedzialnością karną. Instytucja ta daje sprawcy, który dobrowolnie odstępuje od czynu przestępnego, możliwość zwolnienia od kary. Jedną z ustawowych przesłanek czynnego żalu jest dobrowolne odstąpienie.

Active repentance is one of the most important regulations of penal law. The main purpose of this regulation is to deter perpetrator from doing a wrongful act. Active repentance is correlated with the matter of criminal liability. It gives perpetrator, who voluntarily desists from a criminal act, the possibility of exemption from penalty. One of the statutory conditions of the active repentance is voluntary desistance.
