Instytucja czynnego żalu jest jedną z najważniejszych instytucji prawa karnego. Głównym celem tej regulacji jest odstraszenie sprawcy od popełnienia czynu przestępnego. Czynny żal pozostaje w korelacji z odpowiedzialnością karną. Instytucja ta daje sprawcy, który dobrowolnie odstępuje od czynu przestępnego, możliwość zwolnienia od kary. Jedną z ustawowych przesłanek czynnego żalu jest dobrowolne odstąpienie.Active repentance is one of the most important regulations of penal law. The main purpose of this regulation is to deter perpetrator from doing a wrongful act. Active repentance is correlated with the matter of criminal liability. It gives perpetrator, who voluntarily desists from a criminal act, the possibility of exemption from penalty. One of the statutory conditions of the active repentance is voluntary desistance.
