Kategoria bezpieczeństwa w ujęciu prawno-filozoficznym

Abstract

In the constitutional law security is strictly bound to the state. State security entails the state in which the nation may develop. It materialises a natural and primordial need of these states as it conditions the possibility to implement other needs related to the functioning of the state. Therefore it holds a value that is stimulating in nature as it triggers off decision making towards ensuring other values and needs of the society organised into a state. Thus security becomes a primary national mission of the entire society as a state organisation which aims at the protection and defence of national values and interests against the existing and potential threats, as well as a creation of internal and external conditions for an unhindered development. However, in tense situations or conflicts, ensuring security becomes an objective to which all means and forces are subjected.

Bezpieczeństwo jest procesem złożonym, w którym ścierają się funkcjonujące wyzwania i zagrożenia, percepcja społeczna i koncepcje ich rozwiązywania oraz działania i oddziaływania państw oraz instytucji międzynarodowych, zmierzające do budowania ich pewności przetrwania, posiadania i swobód rozwojowych. W takim ujęciu bezpieczeństwo jest jedną z fundamentalnych potrzeb podmiotu i zarazem jednym z najważniejszych celów jego działania, niezależnie od tego, czy podmiotem tym jest jednostka ludzka, czy państwo. Również znaczenie etymologiczne pojęcia bezpieczeństwa (w dosłownym tłumaczeniu bezpieczeństwo to nic innego jak brak zmartwień, poczucia strachu czy obaw) wskazuje na jego podmiotowy charakter związany z brakiem zagrożeń oraz poczuciem pewności podmiotu.
