Zastosowanie i rola mechanizmów skargowych jako środka kontroli nad realizacją zobowiązań przyjętych przez Kazachstan w ramach traktatowego systemu ochrony praw człowieka ONZ

Abstract

Kazachstan nie uczestniczy obecnie w żadnym regionalnym systemie ochrony praw człowieka opartym na zobowiązaniach prawnych, jest natomiast objęty tzw. traktatowym systemem praw człowieka utworzonym pod auspicjami ONZ i zaakceptował cztery mechanizmy skarg indywidualnych funkcjonujące w ramach wspomnianego systemu. W artykule dokonano przeglądu skarg przeciwko Kazachstanowi, które zostały dotychczas rozpatrzone na podstawie procedur traktatowych, celem oszacowania praktycznego znaczenia tych mechanizmów. Analiza liczby i przedmiotu skarg oraz treści i stanu implementacji zaleceń wydawanych w rezultacie postępowania skargowego doprowadziła do wniosku, że potencjał procedur skargowych, które mogą być stosowane w odniesieniu do Kazachstanu, nie jest w pełni wykorzystywany. Główne słabości osłabiające skuteczność omawianych mechanizmów to: znikoma wiedza o ich istnieniu (o czym świadczy mała liczba skarg), długi czas postępowań, a także niepełna realizacja przez Kazachstan zaleceń formułowanych w stanowiskach organów traktatowych rozpatrujących skargi. Summary The application and role of individual communications procedures in the process of monitoring the implementation of Kazakhstan’s obligations under the UN human rights treaty-based system Kazakhstan does not participate in any regional human-rights monitoring system based on legal obligations, however its performance in the field of human rights is subject to international scrutiny within the frames of the treaty-based monitoring system of the UN. This control can be exercised by means of four individual communications (complaints) procedures accepted by the State-party in question. The article provides a comprehensive review of the complaints against Kazakhstan, which have already been examined by the international monitoring bodies operating in the UN treaty-based system. The analysis concerning the number and subject matter of such communications, as well as the recommendations received by Kazakhstan and their implementation, leads to the conclusion that the impact of the respective procedures is in practice limited. This situation can be explained primarily by the low awareness of their existence among potential victims of human rights violations in Kazakhstan.
