Ustawa budżetowa na 2015 rok oraz propozycje zmian układu ustawy budżetowej w Polsce

Abstract

The article presents the legal content and system of the 2015 Budget Act and the legal significance of its regulations. In the paper there are also proposals to the new structure Polish Budget Act. The present system of the Budget Act does not include the revenues and expenditure of certain state funds (especially the National Road Fund) and finances of State Treasury companies. The current system weakens the control function and budgetary power of the Parliament. New Polish system of the Budget Act should contain the general budget and several special budgets.

Artykuł przestawia treść i układ ustawy budżetowej na 2015 r.oraz znaczenie prawne jej regulacji. Przedstawia propozycje nowego układu polskiej ustawy budżetowej. Aktualny układ ustawy budżetowej w Polsce powinien być zmieniony. Układ ten nie zawiera bowiem ustaleń dotyczących dochodów i wydatków niektórych państwowych funduszy celowych (zwłaszcza Krajowego Funduszu Drogowego), ustaleń dotyczących spółek Skarbu Państwa i regulacji co do pełnego zakresu deficytu publicznego. Osłabia to kontrolną funkcję ustawy budżetowej oraz podważa prawa budżetowe parlamentu. Kierunkiem służącym zbudowaniu nowego układu ustawy budżetowej w Polsce jest podział tej ustawy na: budżet ogólny (administracyjny) i kilka innych budżetów, dotyczących wyodrębnionych dziedzin aktywności państwa.
