Prawo własności gruntów pod wodami

Abstract

The aim of this article is to analyze the concept of the ownership of land under the waters present in Polish law and to identify its characteristics. The ownership of land under the waters is differentiated in Polish water law from the ownership of waters. Furthermore, the concept of the ownership of land under the waters should be explored not only in the context of its connections with waters, but also in the context of the issue of the ownership of real property (the land). The analysis, presented in the article, enables to formulate postulates de lege ferenda indicating the proper way of regulating the discussed issue in the future reform of the Polish water law.

Celem opracowania jest analiza koncepcji własności gruntów pod wodami w prawie polskim i wskazanie jej charakterystycznych cech. Własność gruntów pod wodami ujmowana jest w polskim prawie wodnym w sposób odrębny od własności wód. Poza tym, własność gruntów pod wodami winna być badana nie tylko w kontekście jej związku z wodami, lecz również w kontekście własności nieruchomości gruntowej. Przedstawiona w artykule analiza prowadzi do sformułowania wniosków de lege ferenda co do ujęcia badanej tematyki w projektowanych zmianach w systemie polskiego prawa wodnego.
