The Act of 20 July 2017 of the National Real Property Resources introduced amendments to the Act of Ownership of Premises of 24 June 1994, consist-ing of the addition of three new editorial units in the existing Articles 2, 7, and 11. When setting up separate ownership of premises, the new regula-tion imposes an obligation to take into account administrative acts such as: a local land use plan or a decision on land development and land use, and a building permit or an effective application, and permission to use. The Act also provides for a legal action for a declaration of the invalidity of the establishment of separate ownership without a starost (head of district) certificate. The Amendment was necessary, but the editorial aspect of the new legislation raises a number of doubts.
